想請教各位先進
如果小弟現在跟奶奶買房子,假設總價款是2200萬
走買賣的形式,貸款把全部的錢匯給奶奶
這樣可以適用土增稅10%優惠稅率及不會被課贈與稅
然後奶奶再把這2200萬用每年220的贈與稅免稅額分10年贈與給我
這樣會被認定是假買賣真贈與的資金回流要補課贈與稅嗎?
另外如果真的被補課贈與稅
土增稅原先適用的10%優惠稅率會被改為累進稅率補稅嗎?
這兩個問題麻煩各位先進了
