Table of Contents

應依台灣桃園地方法院為第一審管轄法院，

應該要如何轉成英文..

This Agreement shall be interpreted in accordance with and governed by
the laws of the law of the Republic of China regardless of any choice of law
principles to the contrary

AND Taiwan Taoyuan District Court shall be determent to hold trial court.

請前輩門幫忙看看這句可不可以．

謝謝各位的回應與解答 抱歉，上篇文章未講清楚 1.台灣申請案的初審OA 2.本案 主張日本案的優先權 3.引證案 亦主張日本案的優先權 4.該引證案優先權日早於本案之優先權日 然而該引證案之公開日晚於本案之優先權日 可否用來作為核駁新穎性或進步性的引證案呢?? 根據我目前查到的資料 應該是可以核駁新穎性 ...

做為引證案的日期重點 在公開日 案子 要公開之後 才算是 在 public domain 也才能拿來作為有效引證案 是否核駁 新穎性 或 進步性 和引證案的揭示程度有關 和日期無關 引證案與申請案是否為同一申請人 不會有影響 既然已經在 public domain 的東西 就會被視為是公眾的東西 ...

1.假設有一件引證案，其優先權日早於本案之優先權日 然而該引證案之公開日晚於本案之優先權日 可否用來作為核駁新穎性或進步性的引證案呢?? 根據我目前查到的資料 應該是可以核駁新穎性。但無法用來核駁進步性 不知道這樣對嗎?? 2.如果該引證案跟本案都是同一申請人 那麼上述狀況亦同嗎?? 感謝大家細心解答 ...
