因為種種緣故
友人(沒血緣)要把一個房地產用很低價錢給我
請問一下房屋土地使用 買賣 跟 贈與 兩種方式過戶
兩種方式的利弊
繳稅的部份是不是主要用買賣的
只差在售屋財產交易所得
(房屋交易所得)
如果土地價格是公告現值 634萬
房屋現值是170萬
用800萬的買賣價
售屋財產交易所得
用宜蘭羅東的8%來計算

房屋財產交易應稅所得約:136000元
賣方主要多13萬這個部分
如果所得稅率低的就幾乎沒差
買方則是繳6%的契稅10.2萬
如果用贈與的方式
原本想把土地634萬分3年 每年211萬 低於220萬
第四年再贈與現值是170萬的房屋
但要拖到四年
其他印花稅、登記規費就都一樣
請問這樣理解就錯誤嗎?
