軟體專利授權撰寫方式 - 專利

最近在看一個軟體授權合約，有關於該軟體專利授權的部份的寫法跟一般的
授權寫法不太一樣：

XXX grants Licensee a limited, royalty free, fully paid-up,
non-exclusive, and non-transferablelicense (without the right
to sublicense) under those claims of XXX's patents that
are infringed by the Software alone and not in combination
with any other product, to make, use, sell, offer for sale...

這種寫法跟一般我常看到的授權文字寫法不太一樣，大部分我看到的會
比較像是這種的：

XXX grants Licensee a license under its patents in or to the
Software to make, use, sell.....（大概是這樣比較正面的撰寫方式）

這個軟體是一個使用在公司採購晶片上搭配使用的軟體，該軟體並會隨著
裝載該等晶片之公司產品一併販售給客戶。我想請問一下各位板上先進，
用這樣的反向的寫法(under those claims of XXX's patents that
are infringed by the Software...)是否有任何特殊意義呢？還請各位
