請教迴避設計與防範 - 專利

假設有一個發明是LED array電源控制方法與系統
LED array開始使用過後，光度會衰退。

因此本發明是：
全新的LED，供給電壓 V1。
LED使用一段時間後 (累積 on/off 次數達 N1 後)，供給電壓改為 V2，V2 > V1。

初步擬的 claim 如下

1: 1. A power supplying method implemented by an LED array
2: comprising an LED, a voltage supplying unit coupled to the
3: LED, and a counter coupled to the voltage supplying unit,
4: the method comprising:

5: determing that the counter is greater than N1;

6: supplying, by the voltage supplying unit, a voltage V1 to
7: the LED when the counter is not greater than N1;

8: supplying, by the voltage supplying unit, a voltage V2 to
9: the LED when the counter is greater than N1, wherein V2 > V1; and

10: incremeting, by the voltage supplying unit, the counter
11: at the time when the voltage supplying unit supplies a voltage
12: >= V1 to the LED;

想要向各位請教的是
(1) claim 有什麼寫得不好的地方。
(2) 是否有方法，可獲取大部分的功效，又不會落入 claim。
(我覺得很容易想出來)
(3) 假設回到申請階段，如何修改 claim 防堵 (2) 所想出來的方法?

這就像是是矛與盾的問題，先設計出矛，又修改盾來防範。
我個人覺得在專利的世界，盾會贏得勝利吧。
