藥廠開發出新藥或者新的醫療器材
在申請上市許可證之前常要進行臨床試驗
取得有統計和臨床意義的證據來支持申請
但是專利申請的標的如果在申請專利之前已經
"公開使用"
就失去新穎性而沒資格申請專利
請問新藥或者新的醫療器材在申請專利之前
就已經進行臨床試驗
算不算已經公開使用而不能申請專利?
