不定期租賃可否報稅 - 所得稅

之前和房東簽約一年
合約中載明"乙方(房客)租屋若欲申報所得稅, 須依租金另加計15%補貼給甲方(房東)"
因此今年我申報所得稅時,並未列舉租金當扣除額
租約到期之後
我們並未另簽新約
變為不定期租賃
請問我之後若列舉租金作為扣除額
房東是否仍可依舊約跟我追討15%
還是因為目前沒有簽約 所以房東不可要求15%
