立法院今(29)日三讀通過《再生能源發展條例修正案》,增訂建築物之新建、增建或改
建達一定規模者,除有受光條件不足或其他可免除情形外,起造人應設置一定裝置容量以
上的太陽光電發電設備。
行政院會於去年12月8日通過經濟部擬具「再生能源發展條例部分條文修正草案」,函請
立法院審議。除了行政院版本,立法院多位立委及黨團也分別提出修正草案版本,併案審
查。
在太陽光電部分,再生能源發展條例修法為有效運用建築物屋頂,經濟部參考德國柏林立
法經驗,增訂符合一定條件的新建、增建或改建建築物,應於屋頂設置一定裝置容量太陽
光電發電設備;前項建築物範圍、一定規模、一定容量及其計算方式、受光條件及可免除
情形的認定標準,另外定之,後續經濟部將與內政部共同研商相關子法規範。
至於離岸風電方面,此次修法擴大潛在設置空間。刪除離岸風力發電設置「不超過領海範
圍」的文字,擴大離岸風電可設置範圍,具體開發範圍也會透過跨部會聯合審查機制把關
。小水力發電部分,也修正為利用水道、圳路、管渠或其他水力用水以外用途的水利建造
物之原有水量及落差,以直接設置或另設旁通水路設置的方式,轉換非抽蓄式水力為電能
,且裝置容量未達2萬瓩的發電方式。
生質能發電部分則是刪除原有燃燒型生質能電廠僅能設置於工業區的限制,回歸土地使用
管制規範,使農業設施、工廠等農林剩餘資材可就近做生質能料源運用,增加尋址彈性,
減少料源集運的環境效應與成本。
此外,三讀條文更增訂,為設置地熱能發電設備而有開發地熱能之需要者,應向中央主管
機關申請地熱能開發許可。另,地熱能開發許可的有效期間為5年。但有正當理由者,得
於屆期2個月前向中央主管機關申請展延;經審查核准展延者,每次展延期限不得逾一年
。取得地熱能探勘許可或地熱能開發許可者,若有未依地熱能探勘許可內容探勘地熱能,
或未依地熱能開發許可內容開發地熱能等情形,中央主管機關應通知限期改善;屆期未改
善,處30萬元以上150萬元以下罰鍰,並再通知其限期改善;屆期仍未改善,得按次處罰
。

在太陽光電部分,再生能源發展條例修法為有效運用建築物屋頂,經濟部參考德國柏林立
法經驗,增訂符合一定條件的新建、增建或改建建築物,應於屋頂設置一定裝置容量太陽
光電發電設備;前項建築物範圍、一定規模、一定容量及其計算方式、受光條件及可免除
情形的認定標準,另外定之,後續經濟部將與內政部共同研商相關子法規範。
至於離岸風電方面,此次修法擴大潛在設置空間。刪除離岸風力發電設置「不超過領海範
圍」的文字,擴大離岸風電可設置範圍,具體開發範圍也會透過跨部會聯合審查機制把關
。小水力發電部分,也修正為利用水道、圳路、管渠或其他水力用水以外用途的水利建造
物之原有水量及落差,以直接設置或另設旁通水路設置的方式,轉換非抽蓄式水力為電能
,且裝置容量未達2萬瓩的發電方式。
生質能發電部分則是刪除原有燃燒型生質能電廠僅能設置於工業區的限制,回歸土地使用
管制規範,使農業設施、工廠等農林剩餘資材可就近做生質能料源運用,增加尋址彈性,
減少料源集運的環境效應與成本。
此外,三讀條文更增訂,為設置地熱能發電設備而有開發地熱能之需要者,應向中央主管
機關申請地熱能開發許可。另,地熱能開發許可的有效期間為5年。但有正當理由者,得
於屆期2個月前向中央主管機關申請展延;經審查核准展延者,每次展延期限不得逾一年
。取得地熱能探勘許可或地熱能開發許可者,若有未依地熱能探勘許可內容探勘地熱能,
或未依地熱能開發許可內容開發地熱能等情形,中央主管機關應通知限期改善;屆期未改
善,處30萬元以上150萬元以下罰鍰,並再通知其限期改善;屆期仍未改善,得按次處罰
。
