一個claim明確的問題 - 專利

: 我似乎無法知道什麼是structure和action
: 當然是可以解釋說所有種類data的structure和任何action
: 不過這樣保護範圍就變得超大
: 不知道大家的看法是什麼?

以claim來說 其實這樣算明確 尤其是美國案

大陸案就未必

不過通常所謂的不明確 指的是 你提到一個structure 卻跟method看不出關聯

至於名詞定義 等真的訴訟才會去解讀

本來claim是一種法律用語 法律定訂時也是抽象的

所以其實真正的問題是 structure 是抽象的 但未必不明確

而且真的要了解structure 是長什樣子 說明書的用途 通常會來做列舉式的定義
