問題:

GATT第24條第5款載明「Accordingly, the provisions of this Agreement
shall not prevent [the formation of customs unions and free-trade areas,
provided that] (a) … the duties [with outside parties] shall not on the
whole be higher or more restrictive than the general incidence of the
duties … prior to the formation …」(簡稱WTO criterion)。在目前
Customs Unions (CUs)及Free Trade Areas (FTA)的國際浪潮下，為避免被
「邊緣化」所遭致的損害，相對於此WTO criterion，有所謂的Kemp-Wan rule
及後來的Krishna and Panagariya (2002)的證明，試申論之。
